- introducing necessary changes of criminal and other relevant laws with view to bringing them into full compliance with articles 34 and 35 CRC as well as with OP-CRC-SC
- undertaking studies to assess nature and magnitude of problem
- providing adequate and systematic training to all professional groups concerned
- launching awareness-raising and prevention campaigns targeting in particular children and parents
- seeking assistance from UNICEF, among others

r) accept, as soon as possible, amendment to art. 20, paragraph 1 CEDAW, concerning meeting time of CEDAW

n) many of the countries in which Azerbaijani migrant workers are employed are not yet parties to ICRMW, which may constitute an obstacle to the enjoyment by those workers of the rights to which they are entitled under ICRMW

c) that Azerbaijan has not yet made the declarations provided for in articles 76 and 77 of ICRMW recognizing the competence of the Committee to receive communications from States parties and individuals

c) that Azerbaijan has still not ratified the ILO Migration for Employment Convention (Revised) 1949 (No. 97) or the ILO Migrant Workers Convention (Supplementary Provisions) 1975 (No. 143)

w) acceptance by the State party in May 2008 of the amendment to article 20, paragraph 1, of CEDAW, concerning the meeting time of the Committee

n) adherence to the nine major international human rights instruments enhances the enjoyment by women of their human rights and fundamental freedoms in all aspects of life
r) ratify the treaty to which it is not yet a party, namely, the International Convention for the Protection of All Persons from Enforced Disappearance

w) the continuing process of bringing domestic legislation into line with the provisions of ICERD and other human rights treaties
w) legislative, administrative and practical measures taken, as well as the constitutional amendments made, to improve the promotion and protection of human rights in the State party since the examination of the fourth periodic report, in particular:
- the “National Plan of Action for the Protection of Human Rights in the Republic of Azerbaijan”, approved by decree of the Head of State of 28 December 2006, aimed at inter alia strengthening the dialogue between cultures and cooperation among religions, protection and further development of the cultural heritage of national minorities, development of legal awareness and the legal culture of the population and the prohibition of discrimination
- the amendment to article 25 of the Constitution to introduce the prohibition of the granting of privileges or denial of benefits to anyone on the basis of race, nationality, religion, language, sex or other grounds
- the ratification by the State party in January 2009 of ICRPD and its Optional Protocol, as well as of OP-CAT;
- the measures undertaken by the State to simplify migration procedures, such as the presidential decree of 4 March 2009 on the application of the “single window” principle, the establishment by Decree 560 (2007) of the State Migration Service, the cancellation of entry-exit visas for foreigners and stateless persons who have received permission for temporary and permanent residence in the State party, and the preparation of a draft migration code, which the Committee hopes will be fully consistent with the rights recognized by ICERD and other international human rights treaties
- the efforts undertaken by the State party to promote a culture of religious tolerance, as already emphasized in the report of the Special Rapporteur on freedom of religion or belief, Asma Jahangir, on her mission to Azerbaijan (A/HRC/4/21/Add.2)
- the reforms undertaken in the judiciary and in particular the progress made during the reporting period, with regard to the amendment of the Judges Act, the adoption of the Judicial Council Act, the establishment of the statute of the Judges’ Selection Committee and the Code of Ethics for Judges
- the activities carried out by the Ombudsperson’s Office to raise awareness with regard to provisions of the ICERD and the opening of regional offices of the Ombudsperson in different districts of Azerbaijan, namely in Quba, Sheki, Ganja and Jalilabad
- the progress made in combating trafficking in human beings, through the adoption of the Law on Combating Human Trafficking in 2005, the amendment of the Criminal Code in 2005, the adoption of the National Plan of Action of the Republic of Azerbaijan on Combating Trafficking in Human Beings for the period 2009-2013 and the creation of a relief fund for victims of human trafficking

r) take additional measures to disseminate information about ICERD and the Committee’s general recommendations, and to implement programmes for prosecutors, judges, the Ombudsperson and lawyers that cover all relevant aspects of ICERD
r) monitor the results of such efforts and to include in its next periodic report detailed statistics on court cases in which ICERD was invoked

r) ratify the amendments to article 8, paragraph 6, of ICERD, adopted on 15 January 1992 at the fourteenth meeting of States parties to ICERD and endorsed by the General Assembly in its resolution 47/111 of 16 December 1992
r) in this connection, the Committee cites General Assembly resolution 61/148, in which it strongly urged States parties to accelerate their domestic ratification procedures with regard to the amendment and to notify the Secretary-General expeditiously in writing of their agreement to the amendment

r) consider becoming a party to the International Convention for the Protection of All Persons from Enforced Disappearance and to the Rome Statute of the International Criminal Court

- detailed information, including statistical data, on practical implementation of legislation and recommendations of Committee, in particular regarding rights of persons under police custody and pre-trial detention, implementation of 1998 Compensation Act or other relevant legislation, implementation of article 3 of CAT, and mandate and activities of Ombudsman
- detailed statistical data, disaggregated by crimes, geographical location, ethnicity and gender, of complaints relating to torture and ill-treatment allegedly committed by law enforcement officials, as well as related investigations, prosecutions, and penal and disciplinary sentences

i) provide, within one year, information on response to Committee's recommendations contained in paragraphs 7 (c), (f), (h), (i) and (n) above

i) include in third periodic report on implementation of ICESCR all available information on any measures taken and progress made, particularly with regard to suggestions and recommendations made by CESCR in present concluding observations

r) submit third periodic report before 30 June 2009

CERD underlines importance of role of civil society in full implementation of ICERD
r) promote free functioning of civil society organizations that contribute to promoting human rights and combating racial discrimination
r) consult with civil society groups working in area of combating racial discrimination in elaboration of next report

i) provide information on response to CERD's recommendations contained in para. 10 and 13

r) wide dissemination of present concluding comments in order to make people, including government officials, politicians, parliamentarians and women's and human rights organizations, aware of steps that have been taken to ensure de jure and de facto equality of women, as well as further steps that are required in that regard
r) convene a public forum involving all State actors as well as civil society to discuss the presentation of report and the content of concluding comments
r) continue to disseminate widely, in particular to women's and human rights organizations, CEDAW, OP-CEDAW, CEDAW's general recommendations, Beijing Declaration and Platform for Action and outcome of twenty-third special session of the General Assembly, entitled "Women 2000: gender equality, development and peace for the twenty-first century"

i) include in its second periodic report detailed information on measures taken to follow up on the recommendations made in these concluding observations
r) take all appropriate measures to ensure that these recommendations are implemented, including by transmitting them for consideration and action to members of the Government and Parliament (Milli Meclis), as well as local authorities

n) that the State party’s second periodic report is due on 1 July 2009
r) to submit its second periodic report not later than 1 May 2011

r) focus on those areas in its implementation activities and to report on actions taken and results achieved in its next periodic report
r) submit the present concluding observations to all relevant ministries and to the Parliament so as to ensure their full implementation

r) respond to the concerns expressed in the present concluding observations in its next periodic report in accordance with article 18 of CEDAW
r) submit fifth periodic report by 9 August 2013

i) include in its fourth periodic report, due to be submitted by 1 August 2013, specific, up-to-date information on follow-up action taken on all the recommendations made and on the implementation of the ICCPR as a whole
r) the fourth periodic report be prepared in consultation with civil society organizations operating in the State party

r) reports be made readily available and accessible to the public at the time of their submission, and that the observations of the Committee with respect to these reports be similarly publicized in the official and other commonly used languages, as appropriate

r) submit its seventh, eighth and ninth periodic reports in a single document, due on 15 September 2013, taking into account the guidelines for the CERD-specific document adopted by the Committee during its seventy-first session (CERD/C/2007/1), and that it address all points raised in the present concluding observations

r) disseminate widely reports submitted to the Committee, replies to the list of issues, the summary records of meetings and the conclusions and recommendations of the Committee, in all appropriate languages, through official websites, the media and non-governmental organizations

i) within a year, information on its response to the Committee’s recommendations contained in paragraphs 9, 11, 12 and 26 above

State does not use definition of maternal death that is in line with the standard WHO definition and therefore, it may inaccurately calculate maternal mortality ratio
c) lack of unified methodologies for collecting and analysing data in relation to safe motherhood
c) contraceptives are not included in the list of essential drugs and comprehensive range of contraceptives may not be available to women

r) the Government of Azerbaijan [should] proceed with and strengthen its implementation of the 2004 State programme
r) the international community [should] support the Government’s effort in this regard
r) the Government and international and non‑governmental organizations [should] continue to deliver direct humanitarian assistance, grant allowances in cash and in kind, and exempt displaced persons from payments for public services
> such benefits have gone a long way to alleviating the often very difficult situation of internally displaced persons, removing them would probably put displaced persons in a situation significantly worse than that of the resident population

r) avail itself of technical assistance in the development and implementation of a comprehensive programme aimed at the implementation of the above recommendations and CEDAW as a whole
r) strengthen further its cooperation with the specialized agencies and programmes of the United Nations system, including UNDP, UNIFEM, UNICEF, UNFPA, WHO, OHCHR, and the Statistics Division and the Division for the Advancement of Women in the Department of Economic and Social Affairs

r) integrate economic, social and cultural rights into poverty reduction policies and measures, and in this regard CESCR refers State to Committee's statement on poverty adopted in May 2001
r) allocate larger portions of oil revenues to social sector and continue to seek international technical assistance, as provided for in article 23 of ICESCR
r) ensure that international human rights obligations taken fully into account when State enters into technical cooperation and other arrangements with international organizations

r) make the promotion of gender equality an explicit component of national development plans and policies, and in particular those aimed at poverty alleviation and sustainable development
r) pay special attention to needs of rural women, in particular women living in mountainous and highland areas, ensuring that they participate in decision-making processes and have full access to justice, education, health services and credit facilities
r) take appropriate measures to eliminate all forms of discrimination against women with respect to the ownership and inheritance of land
r) place emphasis on women's human rights in all development cooperation programmes with international organizations and bilateral donors so as to address socio-economic causes of discrimination against women, including those impacting women in rural areas, through all available sources of support

c) the Committee regrets that it has not received sufficient information on the measures taken by the State party to protect the rights of Azerbaijani migrant workers abroad

w) undertaking in a period of transition from totalitarian rule, and armed conflict with resulting displacement of large proportion of population, process of bringing legislation into line with international obligations
w) enactment of significant number of laws in order to harmonize domestic legislation with requirements of ICCPR

w) introduction of offence of torture in new Criminal Code, and State's report of some convictions for this crime

c) fact that definition of torture in new Criminal Code does not fully comply with article 1 of CAT, because, inter alia, article 133 omits references to purposes of torture outlined in CAT, restricts acts of torture to systematic blows or other violent acts, and does not provide for criminal liability of officials who have given tacit consent to torture

c) no information was provided on specific decisions of domestic courts where reference has been made to ICESCR and its provisions

w) enactment of new legislation containing anti‑discrimination provisions, including Criminal Code and Code of Criminal Procedure
