r) avail itself of technical assistance in the development and implementation of a comprehensive programme aimed at the implementation of the above recommendations and CEDAW as a whole
n) the Committee expresses its willingness to continue the dialogue with the State party, including through a country visit by Committee members to provide further guidance on the implementation of the above recommendations and the State party’s obligations under CEDAW
r) strengthen further its cooperation with specialized agencies and programmes of the United Nations system, including the UNDP, UNIFEM, UNICEF, UNFPA, WHO, OHCHR, the Statistics Division and the Division for the Advancement of Women of the Department of Economic and Social Affairs of the Secretariat

n) various legislative measures already taken or proposed with respect to child rights (e.g. amendments to 1980 Marriage Act, 1993 Rape Act, draft Juvenile Justice Act, draft Civil and Criminal Codes, and draft Immoral Trafficking Act)
c) they do not reflect comprehensive rights-based approach to implementation of CRC

c) existing legislation does not contain specific definition of discrimination against women in accordance with art. 1 CEDAW, which prohibits both direct and indirect discrimination

c) in event of conflict between international conventions to which Bhutan is party and domestic legislation, domestic law may prevail

w) the adoption of several legislative and programmatic measures taken with a view to implementing CRC, including:
- the adoption of the Constitution on 18 July 2008 and the inclusion of child rights specific provisions therein
- the inclusion of child-related provisions in the Penal Code, 2004 and the Civil and Criminal Procedure Code, 2001
- the adoption of the Labour and Employment Act of 2007, which establishes 18 years as the minimum age for employment and prohibits the worst forms of child labour
- that the minimum age for voluntary enlistment in the armed forces has been raised to 18 years
- the establishment of a Woman and Child Protection Unit within the police in 2007

> the Committee reiterates its previous recommendation (CRC/C/15/Add.157, para. 13) to adopt a comprehensive children’s code which incorporates the principles and provisions of CRC
r) ensure the draft Child Care and Protection Act is harmonized with CRC and furthermore encourages its speedy adoption

r) the Committee reiterates its recommendation (CRC/C/15/Add.157, para. 27) that the State party continue to review its legislation with a view to ensuring that the definition of the child and minimum age requirements conform to the principles and provisions of CRC, are gender neutral, explicit and enforced by law
r) adopt a clear provision on the definition of the child in child care and protection act which is due to be adopted

w) adoption in 2008 of the first written Constitution, the efforts of the State party to integrate the provisions of CEDAW into the Constitution, and the indication by the delegation that most laws have been harmonized with CEDAW
c) the Constitution does not explicitly include a provision on the applicability of international treaties, including CEDAW, and that it does not specify that, in the event of a conflict between national law and CEDAW, CEDAW would prevail
n) article 7 of the Constitution provides for equal protection before the law which, as the delegation explained, should be interpreted to include formal and substantive equality between men and women, and that article 9 contains specific provisions to safeguard the rights of women
c) the provisions contained in articles 7 and 9 of the Constitution may be narrowly interpreted and regrets that the Constitution does not contain an express and comprehensive definition of discrimination against women in line with article 1 of CEDAW, which prohibits both direct and indirect discrimination

w) child-focused and holistic approach taken in formulating policies and programmes relating to aspects of CRC (e.g. multisectoral strategies such as Comprehensive School Health Programme involving education and health sectors)

r) pursue preparation and development of comprehensive national plan of action for implementation of CRC, through open, consultative and participatory process
r) ensure that CRC Task Force is responsible for intersectoral coordination and cooperation (at and between national and local levels of government), dissemination and training of CRC, coordination of NGO activities in implementation of CRC, as well as coordination in preparation of reports
r) ensure that CRC Task Force is adequately resourced (e.g. financially and professionally)

r) consider establishment of independent national human rights institution, in accordance with Paris Principles relating to status of national institutions, to monitor and evaluate progress in implementation of CRC at national and local levels
r) this institution be accessible to children and empowered to receive and investigate complaints of violations of child rights in child-sensitive manner and to address them effectively
r) seek technical assistance from, among others, OHCHR, UNICEF and European Network of Ombudspersons for Children

r) strengthen existing national machinery, clarify mandate and provide it with adequate decision-making power and human and financial resources to work effectively for promotion of women's human rights at all levels, and enhance coordination among existing mechanisms for advancement of women and promotion of gender equality, including Planning Commission and National Statistical Bureau
r) ensure that National Commission for Women and Children becomes fully functional and is guided in its work by provisions of CEDAW and CRC to ensure full promotion and protection of rights of women and girls
